These terms apply to the Watchful iOS application ("the app"), made by Amin Benarieb. By using the app you agree to them. Where you downloaded the app from the App Store, Apple's standard Licensed Application End User License Agreement also applies.

1. Safety — read this one

Watchful is not a medical device and is not a substitute for adult supervision.

It is a convenience tool. Like any baby monitor — hardware or software — it can be interrupted by Wi-Fi conditions, device sleep, battery depletion, iOS resource management, or bugs. Do not rely on it as your only means of ensuring a child's safety, and always follow safe-sleep guidance from your pediatric authority. Check on your child directly and regularly.

2. What the app is

Watchful turns two Apple devices on the same local network into a video/audio baby monitor. It requires two devices running iOS 17 or later connected to the same Wi-Fi network. Streaming quality and reliability depend on your network and devices, which are outside our control.

3. License

You get a personal, non-exclusive, non-transferable license to use the app on Apple devices you own or control, for private, lawful monitoring within your household or with the informed consent of those monitored. You may not reverse engineer, resell, or redistribute the app except as permitted by law or the App Store terms.

4. Lawful use and consent

You are responsible for using the app legally. Audio and video monitoring of people is regulated in many places; only monitor your own children or people who have consented. The camera device deliberately shows a visible indicator when someone is watching — do not attempt to hide or circumvent it. You are also responsible for securing your own Wi-Fi network.

5. Pricing and future purchases

The monitor is free. If a future version offers an optional, one-time in-app purchase for additional comfort features, it will be processed by Apple under their payment terms, refunds will be handled by Apple through their standard process, and it will never gate the core monitoring function.

6. Privacy

The app collects no data. See the Privacy Policy — it is short and we mean it.

7. No warranty

The app is provided "as is", without warranties of any kind, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation. See section 1: no monitor guarantees delivery of any particular sound, image, or alert.

8. Limitation of liability

To the maximum extent permitted by law, Amin Benarieb shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss or harm arising from reliance on the app for supervision, from missed audio/video, or from interruption of the stream. Where liability cannot be excluded, it is limited to the amount you paid for the app in the preceding twelve months.

9. Changes

We may update the app and these terms; material changes will be reflected on this page with a new effective date. Continuing to use the app after a change means you accept the updated terms.
